By Richard Lahaie Starting a court case Parties are encouraged to give information to each other, in am attempt to prevent the need for so many court cases to be started. So before a claim is issued, especially in personal injury cases, a pre-action Protocol should be followed. This is a list of things to be done and if they parities do not follow the procedure and give the required information to the other party they may be liable for certain costs if they then make a court claim. The information is usually in a letter explaining brief details of how the claim arises; why it is claimed that the other party is at fault; details of injury or other damage and any other relevant matters. The defendant is them given three months to investigate the claim and must then reply, setting out if liability is admitted or if it is denied, with the reasons of the denial. If expert evidence is going to be needed then the parties should try to agree to use one expert. This should lead to many claims being settled, but there will still be some which need to go to court. Which court to use? Where the decision is made to go to court, then the first problem is which court to use. The two courts which hear civil cases are : - The County Court - The High Court For cases where the claim is for 15,000 or less, the case must be started in the County Court. For larger claims you can usually choose to start a case in either the county court of the high court. This is still the position after the Woolf reforms. However, there are some restrictions laid down in the high court and county courts jurisdiction order 1991. These are that: - Personal injury cases over 50,000 must be started in the county court - Defamation actions must be started in the high court. So for most cases over 15.000 a claimant will be able to choose the most convenient court for starting the case. The main points to consider in making the decision are the amount that is being claimed and whether the case is likely to raise a complex issue of law. The fact that a case is started in one court does not necessarily mean that the trial will be there; cases may be transferred from one court to the other for the actual trial, ir this is thought necessary. Once a case is defended the case is then allocated to the appropriate track and at the same time it is possible for it to be transferred to another court. Issuing a claim If you are using the county court, then you can choose to issue the claim in any of the 230 or so county courts in the country. If you are using the high court, then you can go to one of the 20 district registries or the main court in London. You need a claim form called N1. By undertaking this same filtering process to understand the situation similar car owners of that defunct dealership are in, either of these segments could provide the knowledge Alan and others need to make them his choice. Non-dealer mechanics qualified to work on this car could obtain a list of local owners from the manufacturer. They could then initiate a direct mail campaign that focuses on educating car owners about the benefits of doing business with them. They could also mail a postcard to all of their existing customers: If you have friends or family affected by the loss of XYZ dealership, we are standing by to help them. A dealer in a nearby city, presumably with a bigger budget than non-dealer mechanics, could establish a temporary service center to assist car owners of the out-of-business dealership. While it may not be possible for Alan to get there this time to fix his car, theres a good possibility that the next time hes in the market for a new one, he would take time to drive there and make a purchase much bigger than brakes. Success Handler: With your team, reenact the filtering process that your clients might go through in specific situations. Set up several scenarios and look for the best opportunities for your small business. Then develop an action plan to capitalize on these. Consider the following: What is your message and how will you share it with prospects and clients? What will it look like? How will you deliver it? (Direct mail, advertising, Web site, community event, sales call, brochure, open house, newsletter, industry association, etc.) Once you get their attention, what do you want them to do next? (Call, fax, write or e-mail, schedule an appointment, order something, subscribe, enter a drawing, pick out their free gift, turn in their coupon, etc.) Once they contact you or allow you to contact them, what will you do? (Who takes the call? What do they say? What other materials do you provide them?) How will you follow-up? (Call every XX days, place them on your mailing list, invite them to an event or seminar, etc.) Once they buy from you, how will you exceed their expectations? How will you say thank you? How will you keep in touch? What are the opportunities for repeat or additional business from them? How will they know all of your capabilities and services? With what other scarce resources can you identity? Remember, you have to climb inside the shoes of your customers and prospects occasionally to understand how they think and how you will best solve their needs. By Ronald Hudkins I am taking you out of the will, or I am going to disinherit Gregory and leave all my money to Steven, are statements that seem far more like they belong in an Agatha Christie novel than in a serious discussion of estate planning. Although the world is not filled with conniving relations who maneuver endlessly to gain the favor of a truly despicable older family matron or patron who uses their wealth to control them all until it culminates in murder most foul, this model is instructive regarding how changing a will can cause hard feelings between family members and create legal difficulties. The chief legal difficulty created by changing a will is that sometimes the two wills look like sequels to a movie and are literally called (Will I) and (Will II). When this happens there will be, just as in the Agatha Christie mysteries, a group of relatives and friends who are favored by the first will (Will I) and not by the second (Will II). These relatives realize that if they can challenge and get rid of Will II, Will I will take its place, and they set out to get rid of Will II after the deceased is gone and can not take further action. Of course there are also the relations or friends that are favored by the revised will (Will II) and fight to keep it valid in the eyes of the law. There are many ways to attempt to invalidate a will that can be the subject of another article. The point of this article is to make it clear that changing a will by substituting it with another will drafted later in time is an exercise fraught with peril. A better way to go is to expressly change from one will to the other or to expressly repudiate the first will. An express change is a change in writing. For example, if you want to get rid of the first will write that, I hereby repudiate the first will with this writing and all of its provisions hereby are to be considered void. It is difficult to get around the fact that you intend to get rid of the first will entirely if you fail to make such a claim in writing. Once that is settled, then you can begin the second will by stating again that you made another will before and that it is entirely void and does not in any way reflect your desires with respect to your property. And finally, include in the second will that it and it alone are a reflection of what you want when you are gone. Another good way to go is not to let anyone, other than your attorney, know you are making a will or replacing an old will with a new one. People cannot fight over what they have no idea exists or has existed. This is a good way to keep the elements of an Agatha Christie novel regarding wills out of your life and the lives of your heirs. The fictional tyrant who rules the family with their notions of inheritance or disinheritance is the kind of person who has people fighting over their will because they are always blabbing about it. With wills it is best to adopt the policy that loose lips sink ships when it comes to your relatives fighting over what you meant after you are gone.
