Exercise for Weight Loss

By Russ Reina Picture yourself in nature and so long ago that nothing that looks like *man* as we know it has made its mark. Even you arent quite sure just how smart you are! Compared to the predators that hunt you, you suspect youre even a little slow on the uptake. Your kind has not even developed the language to talk about the experience. You are one of the aboriginals, the first people, and you are of this land, indigenous to it. Learning -- because your elders dont quite have the words -- is based on observation. You live by your senses and your relationship with the moment. Sure, you think about things, but not much. The moment is much too important to your survival, and the more you think, the less time you have to act. In this world, action is survival. This is so out of step, you may say, With what life is about now. Okay, test something out. Go in to a forest or wilderness area far away from home and the road, to a place youve never been. Do it on a moonless night, alone, and do it without having anything but the clothes on your back. Walk deeper into the woods. You will will get in touch with an important part of who you are as a human being the same core that lived inside your distant Grandparents lives inside you today. You will immediately switch into a reliance on what you feel rather than what you know. You will take in cues from your external and internal environments and respond to them. As soon as the moment comes that you experience a feeling of rightness in your chest, you will take the action that that feeling dictates. When you follow your gut, you are responding to a feeling of knowingness having little to do with the analysis of a preponderance of information. When you are tuned-in to the moment, you are gathering in impressions and then allowing them to coalesce into a choice. Where do you literally feel this sensation of rightness? From what place do you move? Somewhere a lot closer to your heart than your head. The reliance on information over sensation for survival is a relatively new development in our species. Even living within the idea that we are separate from our environment (as opposed to the experience of being an integral part of it and not perceiving a separation) is a culture that even today exists in only a relatively small part of the world. Every person who relies on nature for his or her survival moves from a sensation-based (a heart-centered) way of being first. This is not to minimize the importance of the brain, it is meant to offer you perspective. You, who are reading this, are simply part of a culture that has forgotten how to do this. If you have any doubts, take a look at the remaining indigenous cultures, like Lakota, Maori, or Inuit among others. They are the remnants of what had once been an unbroken line of a heart-centered way of being. Certain differences between them and us are evident, including their relationship with the environment, non-reliance on verbal communication, cosmologies that are nature-, rather than personality-based, a certain lack of guile, cultures of sharing, and perhaps most telling of all, relationship with time. By Richard Lahaie Starting a court case Parties are encouraged to give information to each other, in am attempt to prevent the need for so many court cases to be started. So before a claim is issued, especially in personal injury cases, a pre-action Protocol should be followed. This is a list of things to be done and if they parities do not follow the procedure and give the required information to the other party they may be liable for certain costs if they then make a court claim. The information is usually in a letter explaining brief details of how the claim arises; why it is claimed that the other party is at fault; details of injury or other damage and any other relevant matters. The defendant is them given three months to investigate the claim and must then reply, setting out if liability is admitted or if it is denied, with the reasons of the denial. If expert evidence is going to be needed then the parties should try to agree to use one expert. This should lead to many claims being settled, but there will still be some which need to go to court. Which court to use? Where the decision is made to go to court, then the first problem is which court to use. The two courts which hear civil cases are : - The County Court - The High Court For cases where the claim is for 15,000 or less, the case must be started in the County Court. For larger claims you can usually choose to start a case in either the county court of the high court. This is still the position after the Woolf reforms. However, there are some restrictions laid down in the high court and county courts jurisdiction order 1991. These are that: - Personal injury cases over 50,000 must be started in the county court - Defamation actions must be started in the high court. So for most cases over 15.000 a claimant will be able to choose the most convenient court for starting the case. The main points to consider in making the decision are the amount that is being claimed and whether the case is likely to raise a complex issue of law. The fact that a case is started in one court does not necessarily mean that the trial will be there; cases may be transferred from one court to the other for the actual trial, ir this is thought necessary. Once a case is defended the case is then allocated to the appropriate track and at the same time it is possible for it to be transferred to another court. Issuing a claim If you are using the county court, then you can choose to issue the claim in any of the 230 or so county courts in the country. By David Handler During the holidays, folks everywhere shop many long hours to buy gifts for the important people in their lives. Spending at this time of year is one of the driving forces of our economy, and retailers go to great lengths to make the frenetic experience a festive one. Macys Thanksgiving Day Parade, the NeimanMarcus catalog, FAO Schwarz toy decorations and Saks Fifth Avenue window displays are all part of Christmas marketing lore. When our kids were young, we lived in the Fort Worth, and each December we drove an hour to Dallas to take our children to Northpark Center. There, our family truly got into the holiday spirit. From the sarcastic Scrooge puppeteer who preys on unsuspecting shoppers, to the bigger-than-life clock tower that performs the 12 Days of Christmas, to the most authentic Santa Claus weve ever seen, shopping at Northpark was truly something we looked forward to every year. Northparks objective is to give shoppers a memorable holiday experience and put them in the spirit to buy more products from the malls stores. In reaching a buying decision, retailers understand buyers go through filtering processes they weigh against their scarce resources: time, money, knowledge and affinity. The Filtering Process: The first thing a customer does to filter information is to review options (think about what you do when youre in the market for a new computer). With a universal list at hand, customers begin distilling options by comparing them based on their own scarce resources. Ultimately, they reach a logical conclusion by placing a value on the various options. Example: Alan owns a foreign car that wont shift into gear. A quick phone call to the dealership where he bought it four years ago reveals that they are no longer in business.
What does he do? In the first stage of his decision-making process, Alan considers all possible means to satisfy his core need getting transportation quickly. He starts by filtering out options: find another dealer in a nearby city; look up non-dealer mechanics in the yellow pages; call AAA; park the car in his garage and wait to see if a new dealership opens; fix the car himself; call his brother-in-law; buy a new car; take the bus; etc. As Alan considers all of these options, his own scarce resources come into play. His busy schedule wont allow him the time to drive to a nearby city. This is his only car, so parking it wont solve the problem; hed just have to rent another one, and he doesnt have the money to do that. He has no knowledge about fixing brakes. He doesnt really have much of an affinity for his brother-in-law. After working through all the scenarios, Alan finally decides to find another mechanic. As you might imagine, how he chooses that mechanic activates an entire new set of filters that take into consideration Alans scarce resources. For instance, since he doesnt know any non-dealer mechanics, he will have to rely on a friends knowledge of which local mechanics are qualified to do the job right. The Marketing Opportunity: Looking at the above example from the mechanics point of view (both non-dealer and those at dealerships in nearby cities) unveils some solid marketing opportunities. By undertaking this same filtering process to understand the situation similar car owners of that defunct dealership are in, either of these segments could provide the knowledge Alan and others need to make them his choice. Non-dealer mechanics qualified to work on this car could obtain a list of local owners from the manufacturer. They could then initiate a direct mail campaign that focuses on educating car owners about the benefits of doing business with them. They could also mail a postcard to all of their existing customers: If you have friends or family affected by the loss of XYZ dealership, we are standing by to help them. A dealer in a nearby city, presumably with a bigger budget than non-dealer mechanics, could establish a temporary service center to assist car owners of the out-of-business dealership. While it may not be possible for Alan to get there this time to fix his car, theres a good possibility that the next time hes in the market for a new one, he would take time to drive there and make a purchase much bigger than brakes. Success Handler: With your team, reenact the filtering process that your clients might go through in specific situations. Set up several scenarios and look for the best opportunities for your small business. Then develop an action plan to capitalize on these. Consider the following: What is your message and how will you share it with prospects and clients? What will it look like? How will you deliver it? (Direct mail, advertising, Web site, community event, sales call, brochure, open house, newsletter, industry association, etc.) Once you get their attention, what do you want them to do next? (Call, fax, write or e-mail, schedule an appointment, order something, subscribe, enter a drawing, pick out their free gift, turn in their coupon, etc.) Once they contact you or allow you to contact them, what will you do? (Who takes the call? What do they say? What other materials do you provide them?) How will you follow-up? (Call every XX days, place them on your mailing list, invite them to an event or seminar, etc.) Once they buy from you, how will you exceed their expectations? How will you say thank you? How will you keep in touch? What are the opportunities for repeat or additional business from them? How will they know all of your capabilities and services? With what other scarce resources can you identity? Remember, you have to climb inside the shoes of your customers and prospects occasionally to understand how they think and how you will best solve their needs. Whether its designing better marketing materials to help increase their sales, shipping computers across the country while taking all worries off their minds, or simply making the holiday shopping experience for parents a little less stressful, you need to understand why they buy from your small business. Estate Planning - Changing A Will

By Ronald Hudkins I am taking you out of the will, or I am going to disinherit Gregory and leave all my money to Steven, are statements that seem far more like they belong in an Agatha Christie novel than in a serious discussion of estate planning. Although the world is not filled with conniving relations who maneuver endlessly to gain the favor of a truly despicable older family matron or patron who uses their wealth to control them all until it culminates in murder most foul, this model is instructive regarding how changing a will can cause hard feelings between family members and create legal difficulties. The chief legal difficulty created by changing a will is that sometimes the two wills look like sequels to a movie and are literally called (Will I) and (Will II). When this happens there will be, just as in the Agatha Christie mysteries, a group of relatives and friends who are favored by the first will (Will I) and not by the second (Will II). These relatives realize that if they can challenge and get rid of Will II, Will I will take its place, and they set out to get rid of Will II after the deceased is gone and can not take further action. Of course there are also the relations or friends that are favored by the revised will (Will II) and fight to keep it valid in the eyes of the law. There are many ways to attempt to invalidate a will that can be the subject of another article. The point of this article is to make it clear that changing a will by substituting it with another will drafted later in time is an exercise fraught with peril. A better way to go is to expressly change from one will to the other or to expressly repudiate the first will. An express change is a change in writing. For example, if you want to get rid of the first will write that, I hereby repudiate the first will with this writing and all of its provisions hereby are to be considered void. It is difficult to get around the fact that you intend to get rid of the first will entirely if you fail to make such a claim in writing. Once that is settled, then you can begin the second will by stating again that you made another will before and that it is entirely void and does not in any way reflect your desires with respect to your property. And finally, include in the second will that it and it alone are a reflection of what you want when you are gone. Another good way to go is not to let anyone, other than your attorney, know you are making a will or replacing an old will with a new one. People cannot fight over what they have no idea exists or has existed. This is a good way to keep the elements of an Agatha Christie novel regarding wills out of your life and the lives of your heirs. The fictional tyrant who rules the family with their notions of inheritance or disinheritance is the kind of person who has people fighting over their will because they are always blabbing about it. With wills it is best to adopt the policy that loose lips sink ships when it comes to your relatives fighting over what you meant after you are gone. Employment Law - Equal Pay

By Petra Venton The European Court of Justice (ECJ) has handed down its decision in an important equal pay case, Cadman v Health and Safety Executive. In this case, Mrs. Cadman, a Health and Safety Inspector in Manchester received less pay than men in the same pay bracket. In 2001, Mrs. Cadman was paid 35,129 and one of her male colleagues was paid 44,183, over 9,000 more. The pay system was based on length of service. The male colleagues in Mrs. Cadmans team had longer service with the Health and Safety Executive (HSE) and therefore were paid more. Mrs. Cadman argued that the pay system discriminated against women who are more likely to have shorter periods of service, being more likely to have had a career break to look after children. The Court of Appeal referred this case to the ECJ to decide whether the use of length of service as a factor in a pay system requires objective justification. The ECJ had to consider whether employers who operated a pay system based on length of service must prove that their pay system is justified because the employees with longer service perform their duties better. The good news for employers who operate a pay system based on length of service is that the ECJ ruled that employers generally do not need to provide specific justification for using length of service as a criterion in a pay system, even where that results in unequal pay between men and women. Only, where a worker can provide evidence raising serious doubts as to the appropriateness of rewarding experience in this way, having regard to the particular job in question, will such justification be required. Mrs. Cadman will now take her case back to the UK courts to see whether she can raise serious doubts about the appropriateness of the pay system operated by the HSE. The mention of length of service should immediately bring something else to the front of your minds age discrimination. Paying an employee according to length of service is acknowledged to be age discriminatory, as older employees tend to have longer service. Will employers have to justify a pay system based on length of service under the age discrimination legislation? Under the legislation, service related benefits provided up to five years service are allowed. Service related benefits provided to employees with five or more years service, are lawful if the employer can show that they fulfill a genuine business need, such as rewarding experience. One issue to be clarified by the courts will be whether in this context benefits includes pay. We will have to wait and see. In the meantime, if you do operate a pay system based on length of service (and this applies to employees with five or more years service) you should consider whether the system fulfill a genuine business need.
